In these Terms and Conditions, unless the context otherwise requires, the following definitions apply:
“Company” refers to Hitouch Global, its directors, employees, agents, and authorized representatives.
“Client” / “You” refers to any student, parent, guardian, recruitment agent, partner institution, or other individual or entity that engages the Company for its services.
“Services” refers to all educational consultancy, immigration advisory, application support, visa assistance, accommodation sourcing, education loan facilitation, and related services offered by Hitouch Global Ltd.
“Platform” refers to the Hitouch Global website (hitouchglobal.com), student portal (portal.hitouchglobal.com), and any associated digital tools or applications.
“Partner Institution” refers to any university, college, school, or academic institution with which Hitouch Global maintains a formal referral or partnership arrangement.
“Agreement” means these Terms and Conditions together with any service-specific engagement letter, proposal, or agreement signed between the parties.
“Personal Data” has the meaning given to it under applicable data protection legislation, including the Nigeria Data Protection Act (NDPA) 2023.
By accessing the Platform, submitting an enquiry, engaging our Services, or signing any service agreement, you confirm your acceptance of these Terms and Conditions in full.
If you are engaging on behalf of a minor or a third party, you warrant that you have full legal authority to bind that individual to these Terms.
Hitouch Global reserves the right to amend these Terms at any time. Updated Terms will be posted on our website with a revised effective date. Continued use of our Services following any amendment constitutes acceptance of the revised Terms.
If you do not agree to any part of these Terms, you must cease using the Platform and Services immediately.
Hitouch Global is an educational and immigration consultancy. Our Services include, but are not limited to:
• Admissions Guidance — identifying suitable institutions and programs for students
• Application Support — preparing and submitting applications to partner institutions
• Visa Application Assistance — advising on documentation requirements and application procedures
• Immigration Consultancy — providing guidance on study permits, work permits, and relocation
• Education Loan Facilitation — connecting clients with partner financial institutions
• Accommodation Sourcing — linking students with partner housing providers
• Student GIC Assistance — supporting Guaranteed Investment Certificate requirements for Canada
• Pre-Departure and Post-Arrival Support — orientation, travel logistics, and cultural preparation
• Virtual Internship Placement — facilitating remote work experience opportunities
Hitouch Global acts as an intermediary and consultancy. We do not represent, and are not agents of, any government immigration authority, visa-issuing body, or academic institution unless explicitly stated in a separate written agreement.
We do not guarantee admission to any institution, approval of any visa application, or any specific academic or immigration outcome. All decisions rest solely with the relevant institution or government authority.
The Services are provided to eligible clients aged 16 years and above, or to parents/guardians acting on behalf of younger applicants.
You agree to provide accurate, complete, and truthful information at all times when engaging our Services. Any misrepresentation, omission, or falsification of documents or information may result in immediate termination of our engagement and may expose you to legal consequences.
You are responsible for ensuring that all documents submitted to Hitouch Global are genuine, current, and legally obtained.
You agree to respond promptly to requests for additional information, documents, or clarification. Delays caused by the Client do not entitle the Client to a refund or extension of service timelines.
You must not use the Platform or Services for any unlawful purpose, including fraudulent visa applications, identity misrepresentation, or academic fraud.
You agree to keep your portal login credentials confidential and accept full responsibility for all activity conducted under your account.
Hitouch Global offers free initial consultations to students. Specific service fees will be communicated in writing prior to engagement and must be agreed upon before Services commence.
All fees are quoted and payable in the agreed currency. Applicable taxes or levies will be stated separately where required by law.
Payment is due as specified in the service agreement or invoice. Failure to make payment within the agreed timeframe may result in suspension of Services.
Refund Policy:
• Consultation fees are non-refundable once a session has been conducted.
• Application processing fees are non-refundable once an application has been submitted to an institution.
• Visa assistance fees are non-refundable once documentation preparation has commenced.
• Refund requests for services not yet commenced must be submitted in writing within 7 days of payment.
• Hitouch Global is not responsible for fees charged by third parties, including institutions, visa authorities, or financial service providers.
Hitouch Global does not charge students for standard admissions facilitation to partner institutions, as the Company may receive a commission from the institution upon successful enrolment. This does not affect the independence or quality of our advice.
Hitouch Global will exercise reasonable professional care in the delivery of its Services. However, to the maximum extent permitted by applicable law:
• We do not guarantee any specific outcome, including visa approval, institutional admission, scholarship award, or employment.
• We are not liable for decisions made by immigration authorities, academic institutions, financial institutions, or any third-party service provider.
• We are not liable for losses arising from changes in immigration laws, institutional policies, or visa regulations beyond our control.
• We are not responsible for delays caused by the Client, third-party providers, or government processing timelines.
Our total aggregate liability to you for any claim arising from these Terms or the Services shall not exceed the total fees paid by you to Hitouch Global in the three (3) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability which cannot be excluded by law.
All content on the Platform, including text, graphics, logos, software, databases, and course materials, is the intellectual property of Hitouch Global or its licensors and is protected under applicable copyright and trademark laws.
You may not reproduce, distribute, modify, or commercially exploit any content from the Platform without prior written consent from Hitouch Global.
You grant Hitouch Global a non-exclusive, royalty-free license to use any documents, data, or materials you provide to us solely for the purpose of delivering the agreed Services.
Hitouch Global is committed to protecting your Personal Data in accordance with the Nigeria Data Protection Act (NDPA) 2023 and other applicable data protection laws.
By engaging our Services, you consent to the collection, processing, and sharing of your Personal Data as described in our Privacy Policy, available at hitouchglobal.com/privacy-policy.
We collect Personal Data including but not limited to: name, date of birth, passport information, academic records, financial information, and contact details — solely for the purpose of delivering our Services.
We may share your Personal Data with partner institutions, visa authorities, financial providers, and accommodation partners only where necessary to fulfil the agreed Services.
We implement appropriate technical and organisational measures to safeguard your Personal Data against unauthorized access, disclosure, or loss.
You have the right to access, correct, or request deletion of your Personal Data at any time by contacting us at info@hitouchglobal.com.
Hitouch Global may facilitate access to third-party services including, but not limited to, education loans (e.g. MPower Financing), accommodation platforms (e.g. Housemates, University Living, Vanmates), travel insurance providers, e-visa services, and student GIC providers.
These third-party services are governed by the terms and conditions of the respective
providers. Hitouch Global does not accept liability for the performance, quality, or conduct of any third-party provider.
Links to third-party websites on the Platform are provided for convenience only and do not constitute an endorsement of those websites or their content.
Hitouch Global may receive referral fees or commissions from third-party providers. This does not affect the objectivity of our recommendations.
Individuals or entities wishing to become recruitment agent partners of Hitouch Global must complete the official agent registration process at portal.hitouchglobal.com/agent-register.
By registering as an agent partner, you agree to comply with all applicable laws and regulations governing student recruitment in your jurisdiction, including any required licences or certifications.
Agents must not misrepresent Hitouch Global’s Services, partner institutions, or any aspect of the application or admissions process to students.
Commissions are payable to agents in accordance with the Agent Commission Schedule agreed at the time of registration. Hitouch Global reserves the right to amend commission structures with reasonable prior notice.
Hitouch Global reserves the right to suspend or terminate an agent’s partnership at its sole discretion in cases of misconduct, fraud, or non-compliance with these Terms or applicable laws.
Educational institutions wishing to partner with Hitouch Global for student recruitment must enter into a separate written partnership agreement with the Company.
Partner institutions agree to provide accurate, up-to-date information about their programs, admission requirements, fees, and accreditation status for publication on the Platform.
Partner institutions acknowledge that Hitouch Global presents their institutions to students and agents based on student suitability and program fit, not exclusively on commercial considerations.
Partner institutions are solely responsible for all admissions decisions, student welfare obligations, and compliance with applicable education laws and regulations in their jurisdiction.
Both parties agree to keep confidential all non-public information disclosed in connection with the provision of Services, including but not limited to business strategies, student data, pricing structures, and proprietary processes.
This confidentiality obligation does not apply to information that: (a) is or becomes publicly available other than through a breach of these Terms; (b) is independently developed by the receiving party; or (c) is required to be disclosed by law or court order.
The confidentiality obligations under this clause survive termination of the Agreement for a period of three (3) years.
Either party may terminate the engagement upon written notice. Where Services have already commenced, fees for work completed are non-refundable.
Hitouch Global reserves the right to immediately terminate Services without notice or refund if:
• The Client provides false, misleading, or fraudulent information or documents.
• The Client engages in conduct that is abusive, threatening, or unlawful towards Hitouch Global staff or partners.
• The Client uses the Platform or Services for any unlawful purpose.
• Continuing the engagement would expose Hitouch Global to legal, regulatory, or reputational risk.
Upon termination, the Client’s access to the Platform will be revoked. Clauses relating to confidentiality, data protection, intellectual property, and limitation of liability survive termination.
In the event of any dispute arising from these Terms or the Services, the parties agree to first attempt resolution through good-faith negotiation within 30 days of the dispute being raised in writing.
If the dispute is not resolved through negotiation, either party may refer the matter to mediation administered by a mutually agreed mediator.
If mediation fails, the dispute shall be submitted to arbitration under the Arbitration and Conciliation Act (Nigeria), with proceedings conducted in the English language.
Nothing in this clause prevents either party from seeking urgent injunctive or other interim relief from a court of competent jurisdiction.
These Terms and Conditions are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
Subject to the dispute resolution provisions in Clause 14, each party irrevocably submits to the exclusive jurisdiction of the Nigerian courts in respect of any dispute arising under or in connection with these Terms.
Entire Agreement: These Terms, together with any signed service agreement or engagement letter, constitute the entire agreement between the parties and supersede all prior representations, negotiations, and understandings.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
Waiver: Failure by either party to enforce any provision of these Terms does not constitute a waiver of the right to enforce that provision at a later time.
Force Majeure: Hitouch Global shall not be liable for any delay or failure to perform its obligations resulting from circumstances beyond its reasonable control, including but not limited to acts of God, government actions, changes in immigration laws, pandemics, or natural disasters.
Assignment: You may not assign or transfer your rights or obligations under these Terms without prior written consent from Hitouch Global. Hitouch Global may assign its rights to a successor entity in the event of a business transfer or restructuring.
Notices: All notices under these Terms must be in writing and delivered by email to info@hitouchglobal.com or by post to the Company’s registered address.
